Terms of Service

By downloading, installing, or using Kapsicum ("the Software"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Software.

Kapsicum is a local-first personal data tool for macOS that stores information on your device. Some features may optionally connect to external services (such as AI language models or cloud backup), which are described in our Privacy Policy.

Kapsicum is currently in a pre-launch period and provided free of charge. This is not a commitment to remain free. During this period:

• Features may change, be added, or be removed at any time
• The Software may contain bugs or incomplete functionality
• We make no guarantees about uptime, reliability, or data preservation
• We do not make promises about specific features, timelines, or capabilities

Use the Software at your own discretion. We recommend keeping independent backups of any important data.

We may introduce paid plans, subscriptions, or one-time licenses in the future. If we do:

• We will make reasonable efforts to notify you before any pricing takes effect
• We will make reasonable efforts to allow you to export your data if you choose to stop using the Software
• Your locally stored data remains yours regardless of your subscription status
• We may collect limited usage metrics (such as storage used or number of devices) to determine applicable plans and verify valid licensing — see our Privacy Policy for details

We grant you a limited, non-exclusive, non-transferable, revocable license to use Kapsicum for personal or commercial purposes, subject to these Terms.

You agree not to:

• Reverse engineer, decompile, or disassemble the Software
• Use the Software for any unlawful purpose
• Attempt to gain unauthorized access to our systems or services
• Redistribute, sublicense, or resell the Software
• Remove any copyright or proprietary notices from the Software

Kapsicum may integrate with third-party services such as AI language models or cloud storage providers. When you choose to use these features:

• Your data will be sent to those services only with your explicit consent
• We are not responsible for the availability, accuracy, or terms of third-party services
• Each third-party service has its own terms and privacy policy, which you should review

Kapsicum, including its code, design, and documentation, is owned by us and protected by copyright and other intellectual property laws. These Terms grant you a license to use the Software — they do not transfer ownership of the Software itself.

The data you create and store using Kapsicum is yours. We claim no ownership over your personal data.

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE (WHICH MAY BE ZERO DURING THE FREE PERIOD).

You can stop using Kapsicum at any time by uninstalling it. We may terminate or suspend your access to the Software at any time, with or without cause. Upon termination, your locally stored data remains on your device.

We may update these Terms from time to time. We will make reasonable efforts to inform you of material changes, but it is your responsibility to review these Terms periodically. The "Last updated" date at the top of this page will reflect the most recent revision.

Continued use of the Software after the effective date of updated Terms constitutes your acceptance of those changes.

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Software.
